Idaho's Cannabis Laws: Total Prohibition
Idaho is one of only a handful of US states with zero cannabis tolerance — no medical program, no decriminalization, no CBD exceptions beyond federal hemp law:
Possession:
Under 3 ounces: Misdemeanor — up to 1 year jail, $1,000 fine
Over 3 ounces: Felony — up to 5 years prison, $10,000 fine
Any amount of concentrates (wax, shatter, vapes) is a felony — up to 5 years
Paraphernalia:
Possession of pipes, bongs, or vaporizers with residue: misdemeanor, up to 1 year jail
Trafficking:
Bringing cannabis into Idaho from a legal state: felony trafficking charges with mandatory minimum sentences
1-5 lbs: 1-5 years mandatory minimum
Over 5 lbs: 5+ years mandatory minimum
CBD: Only hemp-derived CBD products with 0.0% THC (not the 0.3% federal standard) were Idaho's rule, though enforcement has relaxed since the 2018 Farm Bill. Still, Idaho's definition of marijuana includes ALL parts of the cannabis plant, creating legal uncertainty for CBD products.
No reform in sight: Idaho's legislature has actively resisted cannabis reform. A constitutional amendment to legalize is nearly impossible in the state. Do not expect any change soon.
Border Crossings: The Real Danger
Idaho shares borders with three fully legal states (Oregon, Washington, Nevada) and two medical states (Montana, Utah). This creates the most dangerous cannabis border situation in America:
Oregon → Idaho (I-84):
Ontario, Oregon (right on the border) has numerous dispensaries specifically serving Idaho residents
Idaho State Police and county sheriffs actively patrol I-84 east of the border
They profile vehicles with Oregon plates and look for dispensary bags
Dozens of people are arrested weekly on this corridor
Washington → Idaho (US-95, I-90):
Similar enforcement pattern on routes from Spokane/Pullman into Idaho
Moscow, Idaho (near Pullman, WA) sees significant enforcement
Nevada → Idaho:
Less common route but same rules apply
Critical warnings:
Even TRACE amounts in your car (crumbs, residue, smell) can lead to a search and arrest
Dispensary receipts, bags, or branded materials are probable cause for search
GPS history showing a dispensary visit has been used as evidence
Text messages about cannabis can be used against you if your phone is searched incident to arrest
**If you're driving through Idaho from a legal state: ensure your vehicle is completely clean — no product, no residue, no packaging, no smell. Treat the Idaho border like an international crossing.

Do not make statements about cannabis possession or use
Contact a local criminal defense attorney — cannabis arrests are common and local attorneys know the system
